RERA Important facts to Know

The Real Estate (Regulation and Development) Act, 2016 is an Act of the Parliament of India which seeks to protect home-buyers as well as help boost investments in the real estate industry. The bill was passed by the Rajya Sabha on 10 March 2016 and by the Lok Sabha on 15 March 2016. The Act came into force from 1 May 2016 with 69 of 92 sections notified. The Central and state governments are liable to notify the Rules under the Act within a statutory period of six months. This act has been made in accordance to increasing complaints against the builders or promoters and the real estate agents. These complaints are mainly regarding the late possession of a house to the buyer, irresponsible behaviour of promoters after the signing of the agreement and many such issues. RERA is a government body whose sole purpose is to safeguard the interest of buyers as well as lay a path so that the promoters and the real estate agents get a chance to come up with good services.

STATUS:

1.         What is the status of the Act?

The Real Estate Bill was passed by the Rajya Sabha on 10th March, 2016 and the Lok Sabha on 15th March, 2016, assented to by the President on 25th March, 2016, and published in the Official Gazette on 26th March, 2016.

2.         When did the Act come into force?

Section 2, sections 20 to 39, sections 41 to 58, sections 71 to 78 and sections 81 to 92 were notified by the Central Government to come into effect from 1st May, 2016.

3.         Why have some sections of the Act not been notified yet?

Some sections of the Act have not been notified yet, as the institutional structures, namely the establishment of the Regulatory Authority etc., which are necessary prior to their enforcement have not yet been operationalised in all States. For e.g. projects can only be sold after they are registered with the Authority. In Madhya Pradesh the Rules were notified on 22nd October 2016 and the Authority established on 15th December 2016.

4.         When would the remaining sections of the Act come into force?

Sections 20 and section 43 provide that the Authority and the Appellate Tribunal need to be established within 1 year of the commencement of the Act. The said sections were notified for commencement on 1st May, 2016. Sections of the Act which have not been notified yet, would be notified latest by 30 April 2017.

OBJECTS AND REASONS:

5.         What was the need for a regulatory law for the real estate sector?

The real estate sector has grown in the recent years but has largely been unregulated from the perspective of consumer protection. Though consumer protection laws are available, the recourse available therein are only curative, not preventive. This has affected the overall development of the sector due to absence of professionalism and standardization.

6.         What are the objects and reasons for which the Act has been framed?

The Real Estate Act is intended to achieve the following objectives:

a)     ensure accountability towards allottees and protect their interest;

b)     infuse transparency, ensure fair-play and reduce frauds & delays;

c)     introduce professionalism and pan India standardization;

d)     establish symmetry of information between the promoter and allottee;

e)     imposing certain responsibilities on both promoter and allottees;

f)      establish regulatory oversight mechanism to enforce contracts;

g)     establish fast- track dispute resolution mechanism;

h)     promote good governance in the sector which in turn would create investor confidence.

The Real Estate (Regulation and Development) Act is expected to bring transparency and accountability in the realty sector and ensure consumers will not be cheated or taken for a ride by the developers. The act will also ensure that consumers won't have to endure late deliveries.

Homebuyers can approach consumer court as well as RERA if real estate projects delayed.

While hearing a case, Supreme Court ruled that homebuyers can approach consumer forum as well as RERA if a builder fails to deliver a real estate project on time. "Section 79 of the RERA Act does not in any way bar the Commission or Forum under the provisions of the Consumer Protection Act to entertain any complaint."

What the judgement says

"It is true that some special authorities are created under the RERA Act for the regulation and promotion of the real estate sector and the issues concerning a registered project are specifically entrusted to functionaries under the RERA Act. But for the present purposes, we must go by the purport of Section 18 of the RERA Act. Since it gives a right “without prejudice to any other remedy available’, in effect, such other remedy is acknowledged and saved subject always to the applicability of Section 79...," the court held.

The provision that provides us to transfer case from District Consumer forum or State Consumer Commission to RERA? Sec 71 (1) of the RERA Acts says:

“Provided that any person whose complaint in respect of matters covered under sections 12, 14, 18 and section 19 is pending before the Consumer Disputes Redressal Forum or the Consumer Disputes Redressal Commission or the National Consumer Redressal Commission, established under section 9 of the Consumer Protection Act, 1986, on or before the commencement of this Act, he may, with the permission of such Forum or Commission, as the case may be, withdraw the complaint pending before it and file an application before the adjudicating officer under this Act.”


रियल एस्टेट (विनियमन और विकास) अधिनियम, 2016 भारत की संसद का एक अधिनियम है जो घर खरीदारों के हितों की रक्षा करने के लिए और अचल संपत्ति उद्योग में अच्छे निवेश को बढ़ावा देने के लिए बना है। बिल राज्यसभा द्वारा 10 मार्च 2016 को और लोकसभा में 15 मार्च 2016 को पारित कर दिया गया था। 92 में से 69 अधिसूचित वर्गों के साथ 1 मई 2016 से ये अधिनियम अस्तित्व में आया। केंद्र और राज्य सरकारें छह महीने की वैधानिक अवधि के भीतर अधिनियम के अन्तर्गत नियम सूचित करने के लिए उत्तरदायी हैं। इस अधिनियम को बिल्डरों, प्रमोटरों और रियल एस्टेट एजेंटों के खिलाफ शिकायतों में वृद्धि के अनुसार बनाया गया है। इन शिकायतों में मुख्य रूप से खरीदार के लिए घर कब्जे में देरी, समझौते पर हस्ताक्षर करने के बाद भी प्रमोटरों का गैरजिम्मेदाराना  व्यवहार और कई तरह की समस्याएं हैं। RERA एक सरकारी निकाय है जिसका एकमात्र उद्देश्य खरीदारों के हितों की रक्षा के साथ ही प्रमोटरों और रियल एस्टेट एजेंटों के लिए एक पथ रखना है ताकि उन्हें बेहतर सेवाओं के साथ आगे आने का मौका मिले।

1. अधिनियम की स्थिति क्या है?

रियल एस्टेट विधेयक राज्यसभा द्वारा 10 मार्च, 2016 को पारित किया गया था और 15 मार्च, 2016 को लोकसभा, 25 मार्च, 2016 को राष्ट्रपति द्वारा अनुमोदित और 26 मार्च, 2016 को आधिकारिक राजपत्र में प्रकाशित किया गया था।

2. अधिनियम कब लागू किया गया?

1 मई, 2016 से धारा 2, धारा 20 से 39, अनुभाग 41 से 58, खंड 71 से 78 और धारा 81 से 92 अनुभागों को केंद्र सरकार द्वारा अधिसूचित किया गया है।

3. इस अधिनियम के कुछ अनुभागों को अभी तक क्यों सूचित नहीं किया गया है?

अधिनियम के कुछ खंडों को अभी तक अधिसूचित नहीं किया गया है, जैसा कि संस्थागत ढांचे, अर्थात् विनियामक प्राधिकरण आदि की स्थापना, जो उनके प्रवर्तन से पहले जरूरी है, अभी तक सभी राज्यों में लागू नहीं हुआ है। उदाहरण के लिए परियोजनाओं को केवल प्राधिकरण के साथ पंजीकृत होने के बाद ही बेचा जा सकता है। मध्य प्रदेश में नियम 22 अक्टूबर 2016 को अधिसूचित किए गए थे और 15 दिसंबर 2016 को स्थापित प्राधिकरण।

4. अधिनियम के शेष वर्ग कब लागू होंगे?

धारा 20 और खंड 43 में यह प्रावधान है कि प्राधिकरण और अपीलीय ट्रिब्यूनल को अधिनियम के प्रारंभ के 1 वर्ष के भीतर स्थापित करने की आवश्यकता है। 1 मई 2016 को शुरू किए गए खंडों को अधिसूचित किया गया था। अभी तक अधिसूचित नहीं किए गए अधिनियम के अनुभागों को 30 अप्रैल 2017 तक नवीनतम सूचित किया जाएगा।

उद्देश्यों और कारण:

5. अचल संपत्ति क्षेत्र के लिए एक नियामक कानून की क्या आवश्यकता थी?

अचल संपत्ति क्षेत्र हाल के वर्षों में उगा हुआ है लेकिन उपभोक्ता संरक्षण के परिप्रेक्ष्य से बड़े पैमाने पर अनियमित किया गया है। हालांकि उपभोक्ता संरक्षण कानून उपलब्ध हैं, इसमें उपलब्ध आसरा केवल प्रतिरक्षित नहीं है, निवारक नहीं है। व्यावसायिकता और मानकीकरण की अनुपस्थिति के कारण इसने क्षेत्र के समग्र विकास को प्रभावित किया है।

6. कौन से वस्तुएं और कारण हैं जिसके लिए अधिनियम तैयार किया गया है?

रियल एस्टेट अधिनियम का उद्देश्य निम्नलिखित उद्देश्यों को प्राप्त करना है:

क) आवंटियों के प्रति उत्तरदायित्व सुनिश्चित करना और उनके हितों की रक्षा करना;

ख) पारदर्शिता को लागू करना, निष्पक्ष खेल सुनिश्चित करना और धोखाधड़ी और देरी को कम करना;

सी) व्यावसायिकता और पैन इंडिया मानकीकरण पेश करें;

डी) प्रमोटर और आबंटन के बीच सूचना की सममितता स्थापित करना;

ई) प्रमोटर और आबंटियों दोनों पर कुछ ज़िम्मेदारियां लगाई गईं;

च) अनुबंधों को लागू करने के लिए नियामक निरीक्षण तंत्र की स्थापना;

छ) फास्ट-ट्रैक विवाद समाधान तंत्र स्थापित करना;

ज) इस क्षेत्र में अच्छे प्रशासन को बढ़ावा देना जो बदले में निवेशकों का आत्मविश्वास पैदा करेगा।
